Jacqueline Michalik appeals the dismissal with prejudice of her amended complaint against Allstate Insurance Company. We reverse.
After Michalik and her husband filed a claim against a third party for personal injuries suffered in a car accident, the third party’s insurance company paid the claim pursuant to the Underinsured Motorist Coverage (“UMC”) endorsement of Michalik’s automobile policy. The third party’s insurance carrier tendered to Michalik’s personal injury protection (“PIP”) carrier, Allstate, its UM/UIM obligation to Michalik’s insurer. Allstate then initiated a suit for contribution against the third party, her insurer, and Michalik’s insurer. Allstate sought a declaratory judgment that it was not required to pay Michalik’s underinsured motorist claim under the UMC endorsement, and that it was entitled to its proportionate share of the $100,000 paid to Michalik by the third party’s insurer pursuant to the UMC endorsement. The third party’s insurer did not appear in the suit.
