The proposed FCC measure is called the “Fundamental Flaw in the Rule,” and it comes via commissioner Mignon Clyburn, a Democrat.

This proposal is only one part of the FCC’s effort to kill OTA TV, however. The rest involves legislation from the hill.

Senate communications subcommittee chairman Brian Schatz (D-Hawaii) and Rep. Greg Walden (R-Ore.), the ranking member on the House subcommittee on communications and technology, are working on a bill that would kill OTA TV. It is expected to be voted on in the next few weeks.

Comcast is expected to support the measure.

The network owned by it has been telling broadband providers for a few years to get their customers to pay for a cable subscription, and to also pay for an internet service as well.

As cable revenue is on the rise and broadband subscriptions continue to decline, cable companies are eager to push customers into a subscription for all-in-one services. There is no good reason that a customer should pay twice (or more) to get TV.

So far the FCC has been a lone voice. The proposed rules to kill over-the-air TV are just a part of the commission’s plan to kill OTA TV.

What’s the deal with the proposed “Fundamental Flaw in the Rule”?

The core problem is that some users don’t have access to broadcast TV. A further problem is that some users who do have access to broadcast TV are paying for TV channels they don’t watch.

OTA TV supporters make a pretty convincing argument that an antenna and a simple box will allow the average consumer to access the channels they pay for (especially in the case of digital TV).

Consumers who pay a subscription don’t want to have to pay for the channels they don’t watch.
