The speech prompted the American Civil Liberties Union to sue, demanding that the Justice Department obey the law. “We are not making a judgement that marijuana is safe,” the ACLU said in a 2003 court filing, but “it would seem to us to be fundamental that officers of the executive branch of government who are entrusted with the enforcement of a federal criminal law cannot raid a citizen’s house and forcibly seize not drugs but his computers, books and papers where he has honestly researched and ingested an activity he sincerely believes to be harmless.”
Despite its name, the lawsuit was not a new one. More than a decade before Ashcroft made the drug-enforcement speech, a federal court in Boston had issued a ruling that was quite similar in scope and legal rationale. “The government argues that Congress possessed the power to prohibit the use of all controlled substances,” wrote Judge Mark Wolf, citing the Federalist Papers. “But, in exercising that power, it has ‘confined itself to some few drugs, and those of the most dangerous nature.’ … Even if Congress were to change the definition of a controlled substance to expressly prohibit smoking pot, the Fourth Amendment would still prohibit such a complete prohibition against the private use of marijuana.” In other words, Wolf ruled, Americans cannot be punished for their recreational marijuana consumption.
